Terms of Use for the Fetal Ultrasound Screening Centre Online Store

These terms and conditions are the terms of use (hereinafter referred to as “Terms of Use”) of the e-store of OÜ Loote Ultraheliskriining, register code 11665665, address A.H. Tammsaare tee 47, Tallinn 11316, Harjumaa (hereinafter referred to as “Fetal Ultrasound Centre”).

 

A customer who places an order in the Fetal Ultrasound Centre's e-store (hereinafter "User", or "You") confirms their acceptance of the Terms of Use by ticking the "I agree to the Fetal Ultrasound Centre e-store Terms of Use" box.
 

  1. General provisions
    1. 1.The products (hereinafter "Product" or "Products") are sold to the User via the e-store of the Fetal Ultrasound Centre. The sale takes place in accordance with the Terms of Use valid at the time of placing the order.
    2. 2. Fetal Ultrasound Centre has the right to change the Terms of Use if required by changes in applicable legislation or practices, market developments or the need to specify circumstances or business risks related to the sale of the Products. Changes to the Terms of Use will take effect when they are published on the website www.ultraheli.ee. If You placed your order before the changes or additions took effect, the Terms of Use valid at the time of placing the order will apply to You.
       
  2. Prices
    1. 1. All prices shown in the e-store are in euros and include VAT.
    2. 2. Fetal Ultrasound Centre has the right to change the prices valid in the e-store at any time. If the prices in the e-shop have changed after the User confirms the order and pays for it, then Fetal Ultrasound Centre undertakes to deliver the corresponding Products to the User at the prices valid at the time of ordering. The user does not have the right to demand compensation for the price difference.
    3. 3. Fetal Ultrasound Centre reserves the right to withdraw from the sales contract concluded in the e-store and not to send the ordered Products if the price, description or quality of the Products was incorrectly presented in the e-store or the final price of the shopping cart was incorrect due to a technical or other error and the difference from the correct price was more than 15%. We will notify You immediately if we find an error and will refund You the purchase price immediately, using the same payment method You originally used to pay. You can buy the same Products at the right price indicated in the message by adding the selected items to the cart again. In the event of such withdrawal, you do not have the right to demand compensation for any damage that may arise from the withdrawal.
       
  3. Products and purchasing
    1. 1. The approximate time of order fulfilment is displayed in the e-store.
    2. 2. The product images shown are for illustrative purposes only.
    3. 3. If the Product is out of stock and the order cannot be fulfilled, Fetal Ultrasound Centre has the right to offer a new delivery time or return the money paid. If the User chooses the money, it will be returned to the User immediately, but not later than within 30 days after the purchase. After the refund, the sales contract is considered terminated.
    4. 4. Your shopping cart is created the moment you click the "Add to cart" button next to the Product.
    5. 5. You can change the number of Products in the shopping cart at any time until the order is placed and add or remove Products. Click the "Update" button to confirm a change.
    6. 6. To place an order, press the "Place order" button on the shopping cart page, after which You will be redirected to the ordering page. Before placing an order, You will be presented with a summary of the purchase and, if necessary, You can change Your order. Be careful when filling in the fields on Your data and order form pages, as the fast and smooth delivery of the Products You have ordered depends on the accuracy and correctness of this information. If you want to place an order, press the "Pay" button and you will be directed to the payment method selection page.
    7. 7. You can pay for the Product ordered in the e-store via the Maksekeskus AS payment solution.
    8. 8. To make a payment in the e-shop, press the "Pay" button, after which you will be directed to the Maksekeskus AS payment intermediation page, where you can choose the payment method you like, either:

1) via an internet bank (Swedbank, SEB, LHV Pank, COOP Pank, Luminor) or

2) via credit card (Mastercard or Visa).

3.9. The contract for the sale of Products is considered concluded (entry into force of the sales contract) if You have paid for the order in the e-store ordering environment and the e-store displays Your order confirmation and/or an order confirmation has been sent to Your e-mail.
 

  1. Time and terms of delivery
    1. 1. Ordered Products will be delivered to the User via SmartPOST parcel machines, Omniva courier service or post office. In addition, it is possible to pick up the Product yourself by calling in advance.
    2. 2. Delivery to SmartPost parcel machine is free of charge for an order of 20€ or more, a transport fee of 3.60€ is added for orders under 20€.
    3. 3. Delivery via the Omniva courier service is free of charge for orders of 60€ or more, for orders under 60€, a transport fee of 10€ is added.
    4. 4. Delivery of the Products in stock to the carrier of the shipment will take place as soon as possible after payment of the purchase amount, but not later than within three working days. Delivery of goods not in stock to the carrier of the shipment shall take place within three working days of the arrival of the goods in the warehouse. Unless otherwise indicated in the e-shop, under normal conditions, delivery within the Republic of Estonia will take place within 3 working days after the delivery of the ordered Products to the carrier or postal service provider.
    5. 5. If You wanted Products to be delivered by courier service, they will be delivered to the address indicated by You when ordering. If you wanted to receive  Products from a post office or parcel machine, the Products will be delivered to the parcel machine of your choice or to the post office serving the address indicated when placing the order. It is not possible to change the destination later.
    6. 6. Upon delivery by courier service, the Product will be handed over to You together with a paper or electronic delivery note. Before signing the delivery note displayed on paper or in the electronic terminal, we recommend that you inspect the packaging of the goods and, in the event of external damage, mark a note to that effect on the delivery note of the postal service provider. Please notify us immediately of a Product with damaged packaging by sending an e-mail to pood@ultraheli.ee.
    7. 7. Fetal Ultrasound Centre assumes that the User will receive the goods at the delivery address. The Fetal Ultrasound Centre has the right to transfer the Product at the delivery address to another person who can be reasonably considered by the courier to be the User's representative (in the case of a person, a family member, in the case of an institution, a secretary, an employee of a security desk, etc.).
    8. 8. The User should be aware that by choosing a parcel machine as the place of delivery, access to the parcel machine may be limited by the shopping centre to the opening hours of the shopping centre. If a post office is chosen as the place of delivery, the Product is available only during the opening hours of the post office.
    9. 9. The User agrees that if the User is unable to receive the Product at the time specified by the courier or the User does not pick up the Product from the parcel machine within the time specified by the postal service provider, the Product will be returned to Fetal Ultrasound Centre. Product delivery fee returned to the Fetal Ultrasound Centre will not be reimbursed to the user. In case of re-sending the Product, the User undertakes to reimburse the cost of sending.
       
  2. Withdrawal from the contract
    1. 1. If you are a consumer, you have the right to withdraw from the sales contract for 14 days from receiving the Product by sending a corresponding notice to the e-shop email address (pood@ultraheli.ee) together with the order number and your current account number, and returning the Product at your own expenses to the address “OÜ Loote Ultraheliskriining” A.H. Tammsaare tee 47, 11316 Tallinn, Harjumaa. To withdraw from the sales contract, you may submit a withdrawal application in free form or using the standard withdrawal form for a distance and off-premises contract, which can be found here
    2. 2. All fees received on the basis of the contract, including the costs of delivery of the Product incurred by the User, shall be refunded to the User's current account no later than 14 days after delivery of the withdrawal notice to the Fetal Ultrasound Center, provided that the Product is returned to the address specified in clause 5.1. If you have explicitly chosen a delivery method other than the cheapest regular delivery method offered by the e-store, the Fetal Ultrasound Center will not refund the cost exceeding the cost related to the cheapest regular delivery method.
    3. 3. The returned Product must include all the items and documentation included in the packaging of said Product.
       
  3. Procedure for submitting claims
    1. 1. Products sold from the e-store to consumers are subject to a 2-year claim deadline.
    2. 2. If the User wishes to file a complaint regarding the non-compliance of the Product with the terms of the contract, it must be submitted to the Fetal Ultrasound Centre within two months of the day the User became aware that the Product does not comply with the terms of the contract. The claim shall be submitted to the e-mail address pood@ultraheli.ee.  
    3. 3. In case of a complaint regarding the non-conformity of the Product, the Fetal Ultrasound Centre will review the complaint within 14 days of receiving it.
    4. 4. If the Fetal Ultrasound Centre agrees with the claim, the Fetal Ultrasound Centre has the right to repair the Product or if it is not possible or otherwise expedient, the Fetal Ultrasound Center will replace the defective Product with a similar non-defective Product. If the Product cannot be replaced (the Fetal Ultrasound Centre does not have the Product or it is no longer produced), the Fetal Ultrasound Centre will return the purchase amount paid by the User for the defective Product to the account specified by the User within 14 days of receiving the claim. The shipping cost of the product is not refundable by the Fetal Ultrasound Centre. When replacing a defective Product, the non-defective Product will be delivered to the parcel machine selected by the User.
       
  4. Warranty Cases
    1. 1. The products are covered by a warranty only if it is explicitly stated in the text introducing the Product in the e-store or if the corresponding reference is included in the documentation accompanying the Product. The duration and conditions of the warranty are included in the documents accompanying the Product or in the text introducing the Product in the e-store.
    2. 2. In the event of a warranty claim, please contact the Fetal Ultrasound Centre by sending an e-mail to pood@ultraheli.ee or directly contact the person responsible for the warranty issues (eg. product importer), if they are mentioned in the documentation provided with the Product.
       
  5. Processing of personal data
    1. 1. We process the User's personal data, which we collect through our website. Further information on the processing of personal data can be found in our personal data processing notice, which is available here.
       
  6. Applicable law and dispute resolution
    1. 1. Estonian law applies to the Terms of Use as well as the sales contracts of the Products. All disputes that cannot be resolved through negotiations will be resolved in Harju County Court. Consumers also have the right to go to the court of their place of residence.
    2. 2. If You are a consumer, You have the right to lodge a complaint with the consumer disputes committee through the Consumer Protection Board or to a court. Contacting the committee is free of charge for the User and the User may submit a complaint themself or through a representative. The data of the consumer disputes committee is available on the website of the Consumer Protection Board, here.  If you are located in another EU country, you have the opportunity to lodge a complaint through the European Commission's online dispute resolution platform, here.
    3. 3. Should any provision of these Terms of Use become invalid, void or otherwise inconsistent, it will not affect the validity of the remaining terms.
